Antenati Genealogy Terms of service

Effective date: August 25, 2026

These Terms govern your use of this website and your purchase of genealogical research services from Antenati Enterprises LLC, d/b/a Antenati Genealogy ("Antenati," "we," "us"), of [city], New Jersey. By purchasing a package, a plan, an individual service, or by submitting an inquiry, you agree to these Terms.

1. What we do

Antenati is a genealogical research company. We locate, retrieve and analyze historical records; reconstruct family lines; and produce written reports, family trees, pedigree charts and family history books. We research ancestry worldwide and are not limited to any one country or region.

We do not sell, plan or book travel. Where a client wishes to visit the places their research uncovers, we may refer them to an independent travel company. Any travel arrangements are made under that company's own agreement and its own terms. Nothing in these Terms applies to travel services, and Antenati makes no representation or warranty regarding travel arranged by any other party.

2. Prices are starting prices

All prices published on this site are starting prices. Your final fee depends on the scope of your project — the number of lines and generations researched, record availability, geographic complexity and translation needs. We confirm your final fee, or an estimate with a not-to-exceed cap, in writing before work begins, and we do not exceed a confirmed fee without your written approval.

3. Research outcomes cannot be guaranteed

Genealogical research is an investigation of historical records, and records vary enormously in survival, completeness and accuracy across regions and time periods.

We promise diligent, professional research using sound genealogical methodology, and honest reporting of what the evidence shows — including negative or inconclusive findings. We cannot and do not guarantee that a specific ancestor, place, record, relationship or standing building will be found, or that results will confirm family tradition.

Your fee compensates research time and analysis, not a particular outcome. A finding of "no surviving record" is a legitimate research result.

4. Payment, deposits and refunds

Research fees compensate professional time and expertise. Unless your engagement agreement says otherwise, a deposit of [50%] is due to begin work and the balance is due [before delivery of final materials].

Third-party costs advanced on your behalf — record copies, archive fees, certified copies, translations — are billed [at cost / at cost plus a stated handling fee] and are additional to your research fee. Invoices are payable within [14] days.

You may cancel in writing at any time. The deposit is [non-refundable once research has begun]. Work performed beyond the deposit is billed [pro rata at $[100] per hour], and any unearned balance is refunded. Completed and delivered work is non-refundable.

5. Timelines

Estimated timelines are provided with each proposal and are good-faith estimates. Archive response times, record availability and repository closures can extend them. We keep you informed of material delays.

6. Information you provide

You agree to provide accurate information and any relevant documents you already hold, and to respond to reasonable requests in a timely way. Research quality depends in part on the accuracy of the starting information you provide.

7. Research involving living people

Research concerning living people is conducted using publicly available records only. We never contact a living person on your behalf unless you explicitly request it in writing, and we reserve the right to decline any such request at our discretion.

Identities and details of living individuals are shared only with you, and you agree to use that information lawfully and respectfully.

We do not perform DNA testing. Where DNA is part of a project, we interpret only results from tests you have already taken and provide to us.

8. Deliverables and intellectual property

On full payment, your deliverables — reports, summaries, trees, charts and books — are yours for personal and family use, including sharing with relatives.

Our research methodology, templates and formats remain ours. Underlying historical records may carry their own repository or copyright restrictions on republication. You may not resell deliverables or present our research as your own commercial product.

We may retain copies of research files for our records and will not publish your family's research without your written permission.

9. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of our services is limited to the fees you paid us for the service giving rise to the claim. We are not liable for indirect, incidental or consequential damages, or for losses caused by record repositories, force majeure events, or inaccuracies contained in the historical records themselves. Nothing here limits liability that cannot be limited under applicable law, including under the New Jersey Consumer Fraud Act.

10. Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control — natural disasters, epidemics, strikes, government actions or archive closures — though payment obligations for work already performed remain.

11. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey. The parties will first attempt in good faith to resolve any dispute informally; unresolved disputes will be brought in the state or federal courts located in New Jersey [or: resolved by binding arbitration in [county], New Jersey — choose one with your attorney].

12. General

If any provision is unenforceable, the rest remain in effect. These Terms, together with your signed Research Engagement Agreement, are the entire agreement for your project. Where the two conflict, the signed agreement controls. We may update these Terms prospectively; the version in effect when you engage us governs your project.
